The rules for using Miami WorkConnect, as a worker or as an employer.
DRAFT — NOT YET REVIEWED
This draft describes how Miami WorkConnect works today. It has not been reviewed by a lawyer. The highlighted "Needs review" items must be completed and the whole document checked before launch.
Effective date: to be set at launch.
1. About these terms
These terms are an agreement between you and Miami WorkConnect ("we", "us"). By creating an account or using the site, you agree to them and to our Privacy Policy.
Needs review before launch: Add the legal name and address of the business that operates Miami WorkConnect.
2. What Miami WorkConnect is
Miami WorkConnect is an online marketplace that connects people looking for work with employers hiring in Miami-Dade County, Florida. Workers create a profile and apply to jobs. Employers post jobs and review the people who apply.
We are not an employer, staffing agency or recruiter, and we are not a party to any job offer or employment.
We don't guarantee that any worker will be hired or that any job will be filled.
Match scores (0–100) are an automatic estimate of how well a profile fits what a job asks for. They are information only, and paid placement never changes them.
Job posts can only be published for locations with a Miami-Dade County ZIP code.
3. Accounts
You need an account to apply to jobs or post jobs. Each account is either a worker account or an employer account.
Give accurate information and keep it up to date.
Keep your password private. You're responsible for what happens under your account.
One person per worker account. An employer account is used to manage one company.
Needs review before launch: Set the minimum age to use the site (for example 18, or 16 with limits) and how it is checked.
4. For workers
Creating a worker profile, applying to jobs and using Miami WorkConnect is free for workers.
When you apply to a job, the employer can see your full profile, your contact details (email and phone) and your resume if you uploaded one. Employers can't see your full profile unless you apply to one of their jobs.
You can reply to messages from employers about your applications.
Employers decide who to contact, interview or hire. Always use your own judgment about any job, employer or offer.
5. For employers
You must be authorized to hire for the company you list, and your company details must be accurate.
You may use applicant information only to consider that person for the job they applied to, and you must follow all laws that apply to hiring, including anti-discrimination, wage and hour, and background-check laws.
Keep applicant information private. Don't sell it or share it with anyone who isn't part of your hiring.
Status updates you set (Viewed, Contacted, Interview, Offer, Hired, Rejected) are shown to the applicant.
6. Job post rules
Every job post must:
be a real, current opening that you are hiring for;
be located in Miami-Dade County;
show pay honestly, with a starting amount, a top amount and a pay period;
describe the work accurately;
not discriminate or ask for information the law doesn't allow you to ask for;
not ask applicants to pay anything to apply or to be hired.
We may pause or remove any job post that breaks these rules. A job we pause can't be reactivated by the employer.
7. Plans and payments
Payments are processed by Stripe. We never see or store your full card number.
Monthly plans (Starter $49/month, Business $99/month) renew automatically each month until you cancel.
You can cancel at any time from Plan & Billing. Your plan stays active until the end of the month you've paid for, then ends.
Upgrading takes effect right away and charges the difference for the rest of the billing month. Downgrading takes effect right away and the unused part is credited to your next bill.
If you have more live jobs than your plan allows (for example after downgrading or when a plan ends), the extra jobs are paused, not deleted.
Single jobs (1 day $9, 7 days $24, 30 days $59) are one-time payments. The job goes live once payment is confirmed, as long as it still follows the job post rules, and ends automatically when the time is up. The time runs from purchase, even if you pause the job.
Prices are in US dollars and are shown on the Pricing page and in Plan & Billing.
Needs review before launch: Decide and state the refund policy (for example: no refunds for partial months or used job time, or case by case).
Needs review before launch: Confirm whether sales tax applies to these services in Florida and how it's charged.
8. Things you may not do
Post fake jobs, fake profiles or misleading information.
Harass, threaten, scam or discriminate against anyone.
Use messages to advertise, spam, or ask for payment, bank details or ID numbers.
Copy or collect other people's information from the site, including by automated means.
Try to get into accounts or parts of the site you aren't allowed to use, or interfere with how it works.
9. Your content
You own what you add — your profile, resume, company details, job posts and messages. You give us permission to store and show it as needed to run the service (for example, showing your job post to workers, or your profile to employers you apply to). You're responsible for having the right to share it.
10. Suspension and closing accounts
We may suspend an account or pause job posts that break these terms or put other people at risk. A suspended account can't log in to use the site.
Needs review before launch: There is no self-service "delete my account" button yet. Decide how people ask to close their account (for example by email) and how quickly it's handled, then describe it here and in the Privacy Policy.
11. Disclaimers and limits
The site is provided "as is". We work to keep it accurate and available, but we don't promise it will always be error-free or uninterrupted. We are not responsible for what employers or workers say or do, or for any hiring decision.
Needs review before launch: A lawyer should write the limitation of liability, indemnity, governing law (likely Florida), and dispute resolution sections.
12. Changes and contact
We may update these terms. The effective date at the top shows when they last changed.
Needs review before launch: Decide how people are told about important changes (for example by email or a notice on the site).
Needs review before launch: Add a contact email for questions about these terms.
